PROBATE

If a parent, spouse, or relative, or a close friend passes away with assets in their name, and the estate is over a certain amount, the Nevada law requires that the estate be probated.  Probate is a Court process where a Judge oversees the proper disposition of a person’s estate.

You may be required to obtain “Letters Testamentary” or “Letters of Administration” by a bank or other entity in order to transfer assets.  Even though probate may be more time consuming and costly than a living trust, in some instances it might be more appropriate to have a Court oversee the distribution of assets.
